Pour la vaste majorité de la population, voter ne sert à rien. D'élections en élections, l'écart des richesses continue de se creuser, les attaques contre les travailleurs et les travailleuses se multiplient, les budgets militaires augmentent, les guerres menées contre les peuples des pays exploités se poursuivent, l'extrême pauvreté des populations autochtones au pays perdure, et cela, peu importe les partis au pouvoir, qu'ils soient de droite ou « de gauche ». La raison à cela est bien simple : sous le capitalisme, en dépit du suffrage universel, ce sont ceux qui détiennent le capital – les banques, l'industrie, les ressources naturelles, le commerce, les médias, etc. – qui décident. L'État et le parlement, malgré leur vernis démocratique, ne sont en fait rien d'autre que les appareils dont se sert la bourgeoisie – la classe sociale qui possède les moyens de production – pour maintenir sa domination sur la société. Au Canada, cette domination prend actuellement la forme de la démocratie bourgeoise.

I had just woken up somewhat late, tired of late night arrival of the flight. Just saw missed calls from Prof Ajit Parulekar, who is a colleague and director of Goa Institute of Management where I work a Senior Professor and Chair, Big Data Analytics. He shocked me by informing that the Pune Police reached the campus and are looking for you. He said he is rushing to the campus and would let me know the developments.

I had come on an official meeting at 10 am and hence I had to rush for it. By the time I was through with the meeting there were spate of calls on phone which was kept on slient mode. By that time all the TV channels were flashing the news of nationwide raids on the houses of activists and intellectuals, and arrests of some of them. I called up my wife who said that our house also was opened and searched according to the TV reports. She was obviously scared and already booked the tickets for both of us at 3.45 pm. I asked her to hold on and consulted a lawyer friend who advised that the house needs to be checked by one of us for whether the police planted any object in the house  with an alibi of search. He also suggested that a compliant needed to be filed at the Police station to that effect. As I had some worked planned at Mumbai, I asked my wife to cancel my ticket and to go to Goa. She reached Goa and took the help of a lawyer friend and filed the police complaint.

Students protest in support of Prof SatyanarayanaCondemning police searches in the house of revolutionary writer Varavara Raoʹs daughter Pavana and her husband, Professor Satyanarayana, who is a faculty member in The English and Foriegn Language University (EFLU), located near a century-old Osmania University, students of the EFLU called for boycott of classes on Wednesday. The events took place at Prof Satyanarayanaʹs residence on Tuesday, draw the attention of the country. It is 8:30 am, after sending their daughter to school, the couple about to leave house to perform their duties at their respective educational institutions, as many as 20 police personnal belongs to Maharashtra and Telangana barged in to their house. Dragged their mobile phones and started searches. Itʹs like house arrest situation to the Professor and his wife. By doing so the police personnal cut their contacts with outer world. As the news broken out, as many as 20 faculty members and 100 students of EFLU reached the house and staged sit-in protest on the road. They settled there till 7pm when police concluded their searches and leave the campus. The police even didnʹt allow their daughter in to the house during search operation. The agitators raised slogans against Telangana CM KCR and PM Narendra Modi. They organised a protest rally in the campus. Later addressed the media and condemned the searches.

Oppose the arbitrary arrest of Intellectuals, Dalits and DemocraticRights Activists in India

We the Indian Workers’ Association, Great Britain, condemn the raids on homes of nine human and democratic rights activists across India, on 28th August 2018. 

Amongst the people on whom the raids were conducted include Anand Teltumbde, Stan Swamy, Kranti Teluka and Prof K Satyanarayana. These raids also include Arun Ferreira, Sudha Bharadwaj, Varavara Rao, Gautam Navlakha and Vernon Gonsalves, all five are now under arrest charged, under one of the most draconian law the UAPA (Unlawful Activity Prevention Act). 

This is one of the most barbaric law, copied from the colonial law book, which allows an indefinite detention (arrest) of any citizen theGovernment suspects of having an intent to commit a crime against the State. 

There are many other such laws on the Indian statute, e.g. NSA under which Chandrashekar Azad Ravan, leader of the Bhim Army has been languishing in jail for over a year. These laws must be repealed; they have no place in a democracy.

These raids and arrests follow on from the arbitrary arrests, a few months back, of Sudhir Dhawale, Adv Surendra Gadling, Prof Shoma Sen, Mahesh Raut and Rona Wilson. These five are lawyers, journalist, human rights activists who have been implicated in totally fabricated charges of organising the violence in Bhima Koregaon at the beginning of this year. 
The reality of that incident is being completely overlooked, by the law enforcement authorities, and no investigation is being conducted that leads to the trail of Hindutava instigated violence against the annual peaceful demonstration by the Dalits, marking the victory scored by Marathas against the Peshawar in 1818.

These most recent raids and arrests add to the continued relentless repression, by the Indian Government, on the democratic voice and aspirations of the Indian. This amounts to a very serious attack on the already crumbling state of democracy in India
This could lead to an irreversible phase of fascist rule for many years to come. We appeal to all democratic organisations across India to put aside their differences and unite in the most important endeavour, the need of the hour, that lies before them: 

• Condemn intimidation and arrests of human rights activists and intellectuals by the Indian State!

• Defeat the Manivadi Hindutva fascist rule of the BJP & RSS!

• Build unity amongst Adivasis, Dalits and religious minorities and struggles for their rights!

PUCL also denounces the simultaneous multi-city raids conducted today, 28th August 2018 in a concerted and pre-meditated manner across the country at the premises of other eminent human rights activists including:
·         Father Stan Swamy in Jharkhand;
·         Senior Writer and Poet Varavara Rao, as also the houses of his two daughters and sons-in-law, Anala and the Hindu journalist KV Kumaranath; and Pavana and her husband, Prof. Satyanarayana, of English and Foreign Languages University;
·         Namaste Telangana journalist Kranthi Tekula in Hyerabad;
·         Anand Teltumbde in Goa;
·         Gautam Navlakha in Delhi,
·         Arun Ferreira, Vernon Gonsalves and Susan Abraham, Advocates in Mumbai.

PUCL asserts that the arrests and raids are nothing but a targetted crackdown and attack by the police and state on civil liberties and democratic rights activists across the country in a concerted attempt to crush human rights interventions and silence voices of dissent;
Such systematic and pre-meditated crackdown on human rights activists is unprecedented and unheard of in a democracy and PUCL strongly condemns this unconstitutional crackdown by the state and police;
PUCL stands firmly in solidarity with advocate Sudha Bharadwaj, National Secretary, PUCL and the other human rights activists who face raids and have been arrested under false and fabricated charges.
 We would like to point out that in a Habeas Corpus petition filed before the Delhi High Court, his transfer on transit warrant to Pune has been stayed pending further hearing of the habeas corpus petition tomorrow 29th August, and he is currently under house arrest. As per sources, Anand Teltumbde’s house in Goa was raided by the police in a completely illegal manner, in his absence, after procuring keys from the security guard. While some news channels state that the raids and arrest have been made in the Pune case of Bhima Koregaon caste violence, where the prime accused are Hindutva right wing groups and leaders who are enjoying state impunity and at large, some other news agencies are alleging that the arrests are linked to claims of alleged plot to assassinate Prime Minister Narendra Modi and Chief Minister Devendra Fadnavis.
It is pertinent to note that just last month on 4th July 2018, a scurrilous, motivated, fabricated and malicious media propaganda and hate campaign was run by Republic TV and its anchor Ms. Shivani Gupta, Deputy Editor Mr. Shrawan Sen and its Managing Director, Mr. Arnab Goswami, by way of a series of programmes presented as “Super Exclusive Breaking News” and also showcased by way of a national debate on Prime Time TV. Relying on a fabricated letter allegedly addressed by her to a Maoist named ‘Comrade Prakash’, the channel repeatedly aired, completely false, unsubstantiated and scurrilous accusations against Advocate Sudha Bharadwaj, falsely profiling her as “Urban Naxal”. The allegations were categorically denied by Advocate Sudha Bharadwaj in her rebuttal statement. The programmes were aired with headers of“#UrbanNaxalsExposed” and similar allegations were made against other human rights activists like Mr. Gautam Navlakha in part 2 of the programme, via a second letter supposedly procured by the Channel. PUCL has previously issued a statement dated 7th July 2018 strongly condemning the incident and demanding strict action against the Channel. Advocate Sudha Bharadwaj also issued a legal notice in respect of the Channel’s illegal acts.
The current arrest and raids are taking place in the backdrop of the arrests of  five human rights activists – Advocate Surendra Gadling, Professor Shoma Sen, Rona Wilson, Mahesh Raut and Sudhir Dhawale – who were also arrested under UAPA on 6th June 2018, relying on a similar fabricated letter produced by Republic TV allegedly addressed to the same "Comrade Prakash", in the same Pune case. Following this, on 7th June 2018, Advocate Sudha Bharadwaj had addressed a press conference organized by the Indian Association of People's Lawyers (IAPL) in New Delhi to condemn the arrest of Advocate Surendra Gadling of the Nagpur High Court. Susan Abraham, Arun Ferreira and Vernon Gonsalves are in fact representing the Bhima Koregaon accused in Court.
Advocate Sudha Bharadwaj has been a dedicated trade unionist for more than three decades and has served as a general secretary of its Chhattisgarh branch, during which time the branch did remarkable work in the State. She is also associated with the Chhattisgarh Mukti Morcha, which was founded by the late Shankar Guha Niyogi. She started her legal practice in the year 2000 and has since, fought innumerable cases of workers, farmers, adivasis and poor people in the fields of labour, land acquisition, forest rights and environmental rights. Since the year 2007, she has been practicing in the High Court of Chhattisgarh at Bilaspur and was nominated by the High Court to be a member of the Chhattisgarh State Legal Services Authority. She also supported young lawyers to set up the Jagdalpur Legal Aid group as a civil society initiative to provide legal aid to incarcerated Tribals. She is a visiting faculty at the National Law University Delhi, where she teaches the course on tribal rights and land acquisition. 
PUCL believes that the intention of the state and police in targeting the aforesaid human rights activists by foisting false and fabricated cases against them, is clear and apparent from their profiles of work. All the aforesaid human rights activists targeted in this multi-city “operation” by the police have been tirelessly involved in advocating the cause and fighting for the rights of the most poor, marginalized sections of society against serious state violations and unscrupulous corporates. They have stood for the principles of human rights enshrined in the Indian Constitution and the international standards on human rights.
PUCL strongly condemns the actions of the state and police. This simultaneous crackdown against human rights activists across the country signals the imposition of an unofficial Emergency in our nation and is a direct attack on Indian democracy. This is a deliberate strategy of the state to target noted human rights activists in a clear act of reprisals against them for calling out the human rights violations by the state and police, and to intimidate those who are fighting for justice.
PUCL cautions the public at large on the concerted efforts underway to stifle voices of dissent and threaten the democratic fabric of the country.

In light of the above, PUCL makes the following urgent demands: 
1.          PUCL calls upon the state and the police to immediately and unconditionally release human rights activists, Sudha Bharadwaj,  Gautam Navalakha, Anand Teltumbde, Varavara Rao, Arun Ferreira,  and Vernon Gonsalves and withdraw the false and fabricated case against them;
2.          PUCL calls upon the National Human Rights Commission (NHRC) to urgently intervene to ensure the release of the human rights activists and to  order an immediate, transparent, effective and impartial investigation into the simultaneous multi-city raids and arrests of the human rights activists by the state and the police on false and fabricated accusations and charges ;
3.          PUCL also calls upon the democratic minded citizens of India to condemn the unprincipled manner in which human rights activists are being targeted and oppose such insidious and collusive attempts by State agencies and media outfits to silence human rights activists against the vindictive State policies and action ;
4.          PUCL further condemns the constant profiling as “Urban Naxals/ Maoists” and criminalisation of human rights activists working tirelessly against the state’s anti-people actions and policies, in an attempt to malign them and influence public sentiment.

Against neonazi offensive in Chemnitz Germany

Una forte mobilitazione neonazista è in corso sin dalla scorsa domenica a Chemnitz, città chiamata Karl-Marx-Stadt ai tempi della DDR e ora – un po' come gran parte della Germania Orientale  – tra i luoghi dove più forte è la presenza di componenti organizzate come Pegida. Ma anche dove maggiore consenso sta avendo il partito nazionalista AfD, entrato per la prima volta in Parlamento nelle scorse elezioni con una retorica fortemente xenofoba e suprematista.

I fatti che hanno portato alla mobilitazione derivano dalla morte per accoltellamento di un uomo sabato scorso presumibilmente per mano di una coppia di migranti, uno siriano e uno iracheno, che al momento però sono solamente sospettati di aver commesso il fatto. Il tutto sarebbe a sua volta scaturito tra una lite tra i due e altri tre ragazzi, tra cui la persona che ha perso la vita.

Sin dalle prime ore di domenica in Rete, sul modello che purtroppo ben conosciamo, hanno incominciato a circolare false notizie secondo le quali l'aggressione sarebbe stata motivata da un tentativo di violenza sessuale su una ragazza da parte della coppia ora in carcere. Fomentando l'equazione migrante = violentatore che sin dagi atroci fatti del Capodanno 2017 a Colonia è tra le più abusate del neonazismo organizzato.

Nel pomeriggio di domenica numerosi nazisti, circa 800 secondo lo Spiegel, si sono scagliati contro qualunque persona non sembrasse “sufficientemente tedesca” brandendo bottiglie in una vera e propria caccia all'uomo nel centro cittadino. Un uomo afghano, uno siriano e uno bulgaro sono i tre uomini in condizioni più serie dei trenta che hanno riportato ferite.

Ma l'azione neonazista non si è sedata con lo “sfogo” domenicale. Per il giorno seguente lunedì 28 agosto Pegida ha lanciato un'altra manifestazione, mentre contemporaneamente su Twitter un rappresentante locale dell'AfD incitava all'autodifesa dei tedeschi contro i migranti, data la mancanza della protezione dello Stato nei confronti della “migrazione dei coltelli”. Tra le quattro e le cinquemila persone hanno risposto alla mobilitazione che doveva sfilare per il centro cittadino.

Alla piazza neonazi questa volta però si è contrapposto un concentramento antifa, chiamato a pochi metri di distanza da quello xenofobo, e partecipato da circa 2000 persone. Nonostante il numero soverchiante dei nazi, arrivati per gran parte da località limitrofe, gli antifa sono riusciti a impedire che la manifestazione xenofoba potesse agire liberamente per la città, contrapponendosi al corteo per quanto possibile. Il corteo xenofobo è però sfociato a sua volta, in tipico stile neonazi, in assalti tanti-contro-uno nel corso della notte che hanno portato a ulteriori feriti. La protesta ha un notevole spessore politico sia per quanto riguarda la strada che i palazzi. AfD punta moltissimo sulle prossime elezioni europee sul tema delle migrazioni, per provare ad erodere il dominio politico della Merkel e rivedere in senso ancora più nazionalistico le posizioni della Germania in merito all'Unione Europea. Per farlo ha sfruttato una pagina di cronaca nera, raccogliendo probabilmente anche più consenso di quanto avrebbe pensato, con due giornate indubbiamente problematiche e pericolose data l'alta partecipazione.

Le politiche di Merkel, sotto accusa sin dalla decisione del 2015 di dare la cittadinanza a più di un milione di siriani in fuga dal conflitto locale, sono ora al centro del dibattito pubblico e in passato anche il ministro dell'Interno Seehofer si è esposto in senso della necessità di ridurre ulteriormente le migrazioni in un paese che anche in forza degli accordi di Dublino non ha alcuna reale pressione migratoria al suo interno.

Per Giovedì e Sabato sono lanciate nuove mobilitazioni da parte dei nazi a Chemnitz. Ma proprio ora sono in corso mobilitazioni sotto il Parlamento regionale di Dresda, dove però gli antifa sembrerebbero superiori per numero ai nazi e mentre le istituzioni, impegnate anche nello sgombero dell'occupazione di Hambach, continuano a non andare oltre dichiarazioni di rito sul ristabilimento dell'ordine connivendo di fatto con la mobilitazione neonazista.

‘Why are raids taking place on the homes of lawyers, poets, writers, Dalit rights activists and intellectuals and not those who make up lynch mobs?’




Writer and activist Arundhati Roy on Tuesday reacted to the news of police raids at the homes of human rights activists in multiple cities across the country. “It is as close to a declaration of an Emergency as we will ever get,” the Booker-prize winning author said.
On Tuesday morning, teams of the Pune Police raided the houses of activists in Mumbai, Ranchi, Hyderabad, Delhi, Faridabad and Goa. Among those whose houses were searched are Vernon Gonsalves and Arun Ferreira in Mumbai, Gautam Navlakha in New Delhi, Sudha Bharadwaj in Faridabad and Stan Swamy in Ranchi. In Hyderabad, raids were reported from the homes of Varavara Rao and his family members, and two other activists, Kranti and Naseem. In Goa, Dalit scholar Anand Teltumbde’s house was raided in his absence. Police reportedly took the keys from the security guard and walked in
Some of these activists have been detained by police. The raids are said to be connected to investigations into a public meeting organised days before caste-related violence erupted at Bhima Koregaon near Pune on January 1.
Reacting to these raids and detentions, Roy said that anybody who speaks up for justice or against Hindu majoritarianism is being made into a criminal.
“That the raids are taking place on the homes of lawyers, poets, writers, Dalit rights activists and intellectuals – instead of on those who make up lynch mobs and murder people in broad daylight tells us very clearly where India is headed,” she added.
“What is happening is absolutely perilous,” she said. “It is in preparation for the coming elections. We cannot allow this to happen. We have to all come together. Otherwise we will lose every freedom that we cherish.”

"Police teams from different states are reported to have launched simultaneous raids at the homes of several people in Mumbai, Delhi, Ranchi, Goa and Hyderabad, including activists, priests, writers and lawyers. Human rights advocate Sudha Bharadwaj’s home was also raided and she was taken into custody this morning. Among those whose residences were raided, according to sources, were Susan Abraham, Vernon Gonsalves, Arun Ferreira, Kranthi Tekula, Varavara Rao, Father Stan Swamy, Anand Teltumbde and Gautam Navlakha. A relative of Varavara Rao confirmed that his daughter Anala and son-in-law KV Kurmanath’s house had also been raided. A relative of Abraham said, 'Susan and Arun are defending the accused in the Bhima-Koregaon violence of last January.'
Those arrested included human rights lawyer from Nagpur Surendra Gadling, Dalit rights activist and journalist Sudhir Dhawale, former Prime Minister Rural Development fellow Mahesh Raut, Rona Wilson and Shoma Sen, associate professor from Nagpur University.
The raids began on Tuesday morning and were continuing at the time of writing this. According to sources, laptops, phones and other material was seized from some of the residences. A contingent from Vishrambag police station in Pune, which is investigating the Bhima-Koregaon violence, is part of the raids. There is no confirmation yet why the raids were carried out on such a scale simultaneously."

Manifestação reuniu mais de 200 pessoas no centro do RJ.


No dia 14 de agosto, ocorreu uma importante manifestação no centro do Rio de Janeiro contra a condenação dos 23 ativistas processados por participarem dos grandes protestos 2013 e 2014, contra o genocídio praticado nas favelas do Rio de Janeiro, contra o assassinato político da vereadora Marielle Franco e em defesa do direito de manifestação. Entre os mais de 200 manifestantes, estavam estudantes universitários e secundaristas do Rio de Janeiro e de Niterói, mães e familiares vítimas da violência policial, organizações democráticas e revolucionárias e trabalhadores em educação.
O ato cumpriu importante papel político de denúncia do papel que cumpre a recente condenação de 23 ativistas. Foi denunciado o fato da sentença vir justo no momento em que há uma Intervenção Militar ocorrendo no Rio de Janeiro, responsável pela multiplicação dos assassinatos de jovens negros e pobres nas favelas.

As mães e familiares vítimas da violência policial, ao final do ato na Cinelandia, tomaram parte nas intervenções públicas feitas para denunciar o cotidiano das favelas do Rio de Janeiro e relembrar os assassinatos praticados pelas Polícia Militar, Civil, Bope e Exército que gerou a perda dos seus filhos, filhas, irmãos, primos, sobrinhos, etc. Se unindo à campanha dos 23, bem como às organizações progressistas, democráticas e revolucionárias presentes no ato apontaram que é fundamental seguir numa luta decidida, denunciando todos os crimes praticados pelo velho Estado genocida aumentando a organização do povo pobre na resistência diária.

A manifestação foi o ponto alto da campanha contra a condenação dos 23 ativistas políticos que participaram dos protestos de 2013 e 2014, que tem servido também a levantar importantes bandeiras políticas em defesa dos direitos do povo e contra a Intervenção Militar. Defendendo o que há de mais essencial na luta do povo, o seu direito à se rebelar, a campanha vem marcando a cada semana que passa presença em atos públicos, debates em escolas e universidades, panfletagens e agitações políticas.

Gebze Organize Sanayi Bölgesi’nde (GOSB) yer alan ve çalışanlarının çoğu kadın olan Flormar kozmetik firmasında 15 işçi, Petrol-İş Sendikası’nda örgütlendikleri ve sendikayı işyerine sokmak istedikleri için Mayıs başında işten atıldılar. İşten çıkartılan işçiler, 15 Mayıs’ta fabrika önünde direniş başlattı. İçerde çalışan işçilerin de desteğini alan direnişe, kamuoyu desteği her geçen gün artarken direnişteki işçileri destekledikleri için, “yasa dışı örgütü desteklemek” gerekçesiyle işten çıkartılan işçilerin sayısı da gün geçtikçe artarak 132’ye ulaştı.

Flormar patronları direnişi kırmak için önce “Böl, Parçala, Yönet” taktiği ile, fabrika içinde çalışan işçilerle dışardaki direnişçilerin dayanışmasını kırmaya çalıştı. Direnişteki işçilerle fabraika arasına yüksek tel örgüler ve prandalar çekti. Yeterli olmadı ki; yüksek otobüsler dizdi. Ancak kararlılıklarından hiçbirşey kaybetmeyen direnişçiler eylemlerini sürdürürken, içerdekilerle dışardakilerin dayanışması da artarak devam etti… Bunun üzerine dışarıdaki direnişçilere fiili saldırılar gerçekleştirildi. Direnişteki işçilerin üzerine kasitli olarak servis otobüsü sürüldü, servis şöförü işçilere bıçakla saldırdı.
Flormar patronları, “yasa dışı örgütü desteklemek” ve “yüz kızartıcı suç”  gerekçesiyle işten çıkartmaları sürdürüyor.
Direnişin 53. Günü 06 Temmuz’da, direnişteki işçiler günlük eylemleri olan Yves Rocher mağzaları önü eylemleri için fabrika kapısından ayrıldıktan sonra, Flormar yönetimi, sendika üyesi 7 işçiyi daha “direnişteki arkadaşlarına el sallayıp alkış yaptıkları” gerekçesiyle işten çıkardı. Haberi alan direnişçiler, fabrikaya dönüp; “Flormar’a Sendika Girecek Başka Yolu Yok”, “Kurtuluş Yok Tek Başına, Ya Hep beraber Ya Hiçbirimiz”, “Direne Direne Kazanacağız”, “Ölmek Var, Dönmek Yok!” “Susma Sustukça Sıra Sana Gelecek” sloganları eşliğinde kapıda direnişi sürdürdüler.

g20noNachdem im Dezember die 1. Anklage in sich zusammengebrochen war, wurde der Prozess ausgesetzt und eine neue Anklage konstruiert. Nun endete der Prozess nach 15 Prozesstagen und über ein Jahr nach dem G20-Gipfel mit einem Freispruch! Mehr dazu in der Pressemitteilung der Verteidigung (siehe unten) und bei united we stand.
Das Amtsgericht Hamburg-Altona hat einen 32-jährigen Angeklagten nach 15 Verhandlungstagen in sämtlichen Punkten freigesprochen. Ihm war vorgeworfen worden, während des G20-Gipfels drei Flaschen auf Polizeibeamte geworfen zu haben. Am Samstag ist die Berufungsfrist verstrichen. Die Staatsanwaltschaft hat das Urteil akzeptiert. Damit ist es rechtskräftig.
Das Gericht hat die Arbeit der verdeckt ermittelnden Polizeibeamten deutlich kritisiert. Gleich sechs dieser sogenannten „Tatbeobachter“ gaben an, dem Angeklagten gefolgt zu sein – für zuverlässig hielt das Gericht ihre Angaben jedoch nicht. Die Beamten waren im Gerichtssaal verkleidet aufgetreten. Auf wesentliche Fragen des Gerichts verweigerten sie die Aussage, wobei sie sich auf nicht erteilte Aussagegenehmigungen beriefen. Richter genauso wie Staatsanwältin stellten fest, dass die Polizei auf diese Weise die gerichtliche Sachaufklärung behindere.
Die AnwältInnen haben dem Gericht ein Video vom Tatort und -zeitraum präsentiert, dass den Angaben der Polizeizeugen widersprach. Ob die Zeugen gelogen oder sich geirrt hatten, konnte das Gericht nicht mehr aufklären. Selbst die Staatsanwaltschaft hatte daher Freispruch beantragt.
Die Verteidigerin des Angeklagten, Britta Eder aus Hamburg, ist erfreut über das Urteil: „Meine Erfahrung zeigt, dass in streitigen Prozessen mit derartigen Tatbeobachtern deren Angaben letztlich nie gerichtsfest verwertbar sind.“
Der zweite Anwalt, Lukas Theune aus Berlin, weist auf die Deutlichkeit der Urteilsbegründung hin: „Richter Kloß betonte, dass das Auftreten der Polizei unseriös und unprofessionell war und auf derartige Polizeiarbeit keine rechtsstaatlichen Urteile gestützt werden können. Wir hoffen nun, dass dies auch auf die laufenden und die noch kommenden Prozesse im Zusammenhang mit dem G20-Gipfel Auswirkungen haben wird.“
Der Angeklagte erhält eine Entschädigung in Höhe von fast 4.000 € für die zu Unrecht erlittene Untersuchungshaft von über vier Monaten.

Canada ILPS - Free G.N. Saibaba, the India 5 and all political prisoners in India


On the occasion of the 72nd Independence Day of India, the International League of Peoples’ Struggle (ILPS) in Canada calls for the immediate and unconditional release of all political prisoners in India.
The ILPS in Canada is made up of 25 democratic and anti-imperialist rank and file peoples’ organizations active from Montreal to Victoria, including SANSAD (South Asian Network for Secularism and Democracy) and the East Indian Defence Committee. The Chapter in Canada is part of a global united front organization made up of over 250 peoples’ organizations in 40 countries.
The political prisoners in India include Delhi Professor G.N. Saibaba and his co-accused, as well as five human rights activists working with Dalits, Adivasis and other political prisoners in India who were arrested in June this year.
Professor Saibaba was sentenced to life in prison in 2017, along with Hem Mishra, Prashant Rahi, Mahesh Tirki and Pandu Narote for their alleged links to the Indian Maoists.
The wheelchair-bound Professor Saibaba is presently “on the margins of life” in the notorious Nagpur prison, under brutal conditions of incarceration where basic health assistance has been denied and he reels “under excruciating pain relentlessly”.
Prof. Saibaba, despite his medical and physical condition, has been in the forefront of  democratic struggle for safeguarding the rights of the underprivileged, the deprived, the poor and the powerless. He was an extremely popular teacher at Delhi University, with a passionate interest in reading, researching and teaching literature.
On June 6, 2018, Advocate Surendra Gadling, professor Shoma Sen and activist Mahesh Raut were taken from their homes in Nagpur and in a coordinated operation, the police arrested activists Sudhir Dhawale in Mumbai and Rona Wilson in Delhi.
The India 5 have been accused of being “top urban Maoist operatives” and have been charged, like Prof Saibaba, under sections of the draconian Unlawful Activities (Prevention) Act or UAPA, which includes provisions to ensure long detention and make it difficult to obtain bail.
The 5 are outspoken, high profile activists: Adv Surendra Gadling is General Secretary of the Indian Association of People’s Lawyers; Prof Shoma Sen is Head of the Department of English at Nagpur University; Sudhir Dhawale is the Editor of Vidrohi Magazine; Rona Wilson is Public Relations Secretary Committee for the Release of Political Prisoners; and Mahesh Raut is an anti-displacement activist from Bharat Jan Andolan and former Fellow at the Prime Minister’s Rural Development (PMRD).
They are accused of spreading “hate speech” and even plotting to kill the Indian Prime Minister. In fact, the arrests are clearly a further attempt to silence voices critical of PM Narendra Modi’s ruling BJP party and its Hindutva-linked supporters.
The June 6 arrests are also clearly linked to the case of Professor G.N. Saibaba. Adv Surendra Gadling, who has previously faced constant harassment for handling Prof Saibaba’s case, was due to attend a hearing about Saibaba’s bail request two days after his arrest.
The only “crime” of GN Saibaba, his co-accused, and the India 5 has been their consistent defense of the rights of Dalits, Adivasis (indigenous) and other exploited and oppressed peoples in India and their opposition to the brutal Operation Green Hunt in Central India involving around 100,000 Indian military forces against the Adivasis and their allies, the Indian Maoists.
The ILPS calls for the immediate release of Adv Surendra Gadling, Prof Shoma Sen, Mahesh Raut, Sudhir Dhawale and Rona Wilson. We also repeat our call for the unconditional release of the wheelchair-bound Prof Saibaba, who continues to be held in the Nagpur prison with basic health needs denied.
